Fact Checker: Most smoke companies ban - brave the economy Reno Gazette-Journal

Smoking 2006 Nevada restaurants and bars serving food is significantly harming business.

The Nevada Clean Indoor Air Act was adopted in a ballot election by 54% of voters in 2006. It prohibits the places that serve food with cigarettes, with an exemption for casinos.

The effect is that some companies banned smoking, others stopped serving food so that they could keep smoking while still others have built walls to separate the area smoking area smoking of food bar.

A new study based on sales data was just released by the American Cancer Society Cancer Action Network saying that the Act had no economic impact on restaurants and bars.

The study comes as Tavern owners are pushing Assembly Bill 571, which has passed the stage of the Legislative Committee and facilitate the restrictions of the law allowing to smoke with food service in limited to age, autonomous, bars taverns and saloons.

Bob Bonner, Member of the Board of the Association of Nevada Tavern owners, said in a report to the Associated Press that the cancer group numbers are "absolutely wrong." He said that Act a hard business at his Torrey Pines Pub in Las Vegas and its food sales decreased by 50% the first year after the Act came into force.

A report by applied analysis presents the opposite request that the report of the Cancer Action Network was submitted to the Nevada legislature last month. In her view, the Act has "had a measurable negative impact on the financial performance of Tavern operator in Nevada."

He says that in 2007, sites with licenses of limited, set that includes many taverns, had a 17% decrease in revenue while the "economy" was "essentially flat, suggesting the most, if not all, of the decline in revenues was attributable to the NCIAA.".

In addition, he argues that in the first year that the law was in effect--2007 - about 114 million dollars in revenues has been lost and 358 jobs for restricted licence holders.

Auditor in fact communicated with the Nevada Gaming Control Board to see what is the percentage of restricted licensed consist of taverns. It is not known because the licensees report what types of things that they sell and they are imposed on the victories of game but the number of gaming machines that they have.

Places with restricted licenses generally have slot machines only. They include bars, but also grocery stores, convenience stores and laundromats.

The Department of Taxation of the Nevada track separately restricted sales of licensees. Because these licensees include many places are not affected by the law, even if the Department did follow their turnover, the data would be that useful to determine the impact of the Act.

However, all businesses serving food and drinks are covered by the Act for their sales would give a better image - and tracks the Department of taxation.

The air quality Act came into force on 8 December 2006 - mi-path of the 2007 fiscal year. Food and beverage companies appear to have taken a hit then. Their sales plunge 11.8% of the previous year.

But the new Act the cause? Don't forget: it is arises when the real estate bubble. During the 2007 calendar year, jobs in construction fell by 11.4%, 2006.

The recession has been officially declared by the National Bureau of Economic Research began in December 2007, and it lasted until June 2009. During this time, Nevada has accumulated worst unemployment rate in the nation. Almost everyone was hurting in the law of the month.

Then how things have played since? In fiscal year 2010, casino gaming revenue decreased by 5.6% of the previous year and the Nevada business global sales fell by 10.3%. And restaurants and bars? They were down-year 1.7 per cent - nothing to sing, but much better than global Nevada businesses and casinos.

Statistics of the two parties are not in contradiction.

Yes, the restaurants and bars have been poorly financially in 2007 on the time that the Nevada Clean Indoor Air Act prohibits the combination of food and tobacco, casinos excepted. It was also the time where the construction market remained stagnant as the economy began its downward spiral.

It is difficult to disentangle which of the two events had what effect on the restaurants and bars.

But even if it is accepted as the initial shock of the Act harmed some companies, they have rebounded since return stronger than the rest of Nevada businesses. If air quality Act were still evil taverns and they did not understand strategies to meet the needs of the Act and their clients, it would not be the case.

Truth counter: 4

P.S. Three other articles are worth noting.

First of all, when the indoor air quality Act was approved by voters, there was another referendum question asking if voters wanted essentially that Tavern owners seek now: smoking be allowed in the "areas of game in institutions holding licences of games, bars and other places." The voters of Nevada dismissed the proposal.

Second, in February, the American Lung Association in Nevada led an inquiry told by 802 registered voters.

It is 83 percent support the Act and that "almost eight a margin, more Nevada voters believe the rights of customers and employees to breathe clean air in bars and restaurants outweigh the rights of smokers to quit the premises."

Thirdly, last month, the University of Nevada medical school reported that, "following the implementation of the NCIAA in 2007, hospital admissions in Nevada for friend (, heart attack or acute myocardial infarction) decrease of 346 per year, average while admissions for stroke decreased by 315 per year on average."

"Nevada hospital bills also decrease an annual average of 23.5 million for friend - including a reduction of $900,000 for Medicaid and Medicare $ 7.5 million - and $ 9.8 million for stroke, including a reduction of $600,000 for Medicaid and Medicare $ 4 million."
